Terms & Conditions
These terms cover the use of this website and the basis on which we discuss, quote for and deliver website design and development work. Please read them before sending an enquiry.
These Terms & Conditions ("Terms") govern your use of arlosmartfirm.tech and any enquiry you make to Arlo Smart Firm ("we", "us", "our"). By using this website you agree to these Terms. If you do not agree with them, please do not use the website.
1. Use of This Website
You may use this website to read about our services, view our published packages and contact us. You agree not to use it to attempt unauthorised access, to disrupt or overload it, to scrape it for bulk commercial reuse, to copy its design or written content for republication, or for any unlawful purpose.
We may change, suspend or withdraw any part of the website at any time. We aim to keep it available and accurate, but we do not guarantee uninterrupted availability.
2. Service Enquiries
An enquiry is a request for information. It is not an order, and it does not commit either of us to anything. When you enquire, please give accurate details, because our recommendation and price depend on them.
We may decline an enquiry or a project, for example where the request is outside our services, where the requirements are unlawful, or where we do not have capacity.
3. Package Information
Package names, prices and inclusions on the packages page are published so you can see our starting points before contacting us. They are display prices, shown in US dollars, and are marked as starting prices where further work may be required.
Package inclusions describe the typical deliverables for that package, such as the maximum number of pages, responsive design, basic on-page SEO setup and speed optimisation. Anything not listed within your chosen package is outside its scope until it is quoted and agreed.
We may change published packages and prices at any time. A change does not affect a project whose scope and price you have already confirmed in writing.
4. Quotations
After we understand your requirement, we give you a written quotation setting out the deliverables, the number of pages, the revision rounds included, anything specifically excluded and the total price.
A quotation is valid for the period stated in it. Work begins only after you confirm the quotation and scope in writing. If your requirements change after that, we will quote for the change before carrying it out.
5. Scope of Work and Custom Requirements
The written scope is what governs the project. Requests that fall outside it, for example extra pages, additional design concepts, new sections, custom functionality, third-party integrations, content writing, translation, photography or logo design, are treated as additional work and quoted separately.
We will always tell you when a request is outside scope before doing it, so you can decide whether to add it.
6. Pricing and Payment
No payment is taken through this website. There is no cart and no checkout. Payment terms for a project, including any instalments and the accepted payment method, are agreed with you in writing as part of the quotation.
Unless we state otherwise in your quotation, prices exclude any taxes, duties, bank charges or currency conversion costs that may apply, and exclude third-party costs such as domain registration, hosting, paid plugins, stock images, fonts or payment gateway fees.
7. Revisions
Each project includes the number of revision rounds stated in your quotation. A revision round means one consolidated set of feedback from you, which we then apply.
Feedback that changes the agreed direction, adds new requirements or arrives after the design has been approved may be chargeable, and we will tell you before treating it that way.
8. Content Provided by You
Unless content creation is expressly included in your quotation, you provide the text, images, logo, product information and any other material for the website. You confirm that you own that material or have permission to use it, and that it does not infringe anyone else's rights or break any law.
Delays in providing content are the most common cause of a project running late. We are not responsible for schedule slippage caused by outstanding content or feedback.
9. Third-Party Services
A website often relies on outside services, such as hosting, email delivery, maps, analytics, payment gateways, fonts and plugins. Those services are supplied by their own providers, on their own terms and at their own prices, and they can change or withdraw features without notice.
We integrate the third-party services agreed in your scope, but we are not responsible for their availability, performance, pricing, policy changes or account decisions.
10. Domain and Hosting Responsibility
Unless your quotation says otherwise, the domain name and hosting account are purchased by you, in your own name, and remain under your control. That is deliberate, so you always own your web presence.
We can advise on suitable options and deploy the finished website to the hosting you choose. Renewal payments, account security and any provider-side issues remain your responsibility.
11. Intellectual Property
On full payment of the agreed project fee, you receive the rights to use the delivered website design and page files for your own business.
We retain ownership of our own underlying tools, reusable code components, layout systems and internal working files. Third-party assets such as fonts, stock images, icons and plugins remain the property of their owners and are licensed on their own terms.
The content, design and written material of the arlosmartfirm.tech website itself remain our property and may not be copied or republished without our written permission.
12. Project Delivery
We agree an indicative schedule with you in writing at the start of the project. Timelines depend on the package, the number of pages, the complexity of the work and how quickly content and feedback are supplied.
We do not publish fixed delivery guarantees on this website, because a realistic date can only be given once the scope is known. Where a date is agreed in a quotation, we will tell you promptly if anything threatens it.
13. Client Responsibilities
To keep a project moving, you agree to:
- provide content, images and information promptly and in a usable format;
- give consolidated feedback within the agreed revision rounds;
- nominate one person to approve design and content decisions;
- supply access to any accounts we need, such as hosting, and keep those credentials secure;
- review the delivered website and report anything that does not match the agreed scope within a reasonable period.
14. Limitation of Liability
We provide our services with reasonable skill and care. To the fullest extent permitted by law, we are not liable for indirect or consequential loss, including lost profit, lost revenue, lost data, lost business opportunity, or loss caused by third-party services, hosting outages, search engine decisions or advertising platform decisions.
Where we are found liable in connection with a project, our total liability is limited to the fees actually paid to us for that project. Nothing in these Terms excludes liability that cannot be excluded by law.
15. No Guarantees of Results
We build websites that follow SEO-friendly structure and good performance practice. We do not guarantee search engine rankings, traffic volumes, enquiry numbers, sales, revenue or any other business outcome, because those depend on factors outside our control, including your market, your offer, your budget and the policies of search engines and advertising platforms.
16. Cancellation
If you cancel a project after work has started, fees for work already completed up to the cancellation date remain payable. If we cancel a project for a reason that is not your fault, we will refund amounts paid for work not yet carried out.
Any specific cancellation or refund terms for your project will be set out in your written quotation, and those terms take precedence over this section.
17. External Links
This website may link to third-party websites for convenience. We do not control them, do not endorse them by linking to them, and are not responsible for their content, accuracy or security.
18. Changes to These Terms
We may update these Terms from time to time. The current version is always on this page with the date it was last updated. Continued use of the website after an update means you accept the revised Terms. The version in force when your project quotation was confirmed continues to apply to that project.
19. Governing Law
These Terms are governed by the laws of India, and the courts having jurisdiction over Shimla, Himachal Pradesh, India will have jurisdiction over any dispute, unless a different arrangement is agreed in writing in your project quotation. This does not remove any protection you have under the mandatory law of your own country of residence.
